These Terms of Service ("Terms") govern your access to and use of the Scanner Guard Corporation website, products, and services ("Services"). Please read these Terms carefully, and contact us if you have any questions. By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy.

1. Using Our Services

A. Eligibility

You must be at least 18 years old to use our Services. By agreeing to these Terms, you represent and warrant that you are at least 18 years old.

B. Scanner Guard Corporation Intellectual Property

The Services and their original content, features, and functionality are and will remain the exclusive property of Scanner Guard Corporation and its licensors. The Services are protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Scanner Guard Corporation.

C. License to Use Content

Subject to these Terms, Scanner Guard Corporation grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Services and to download and print any portion of the Content to which you have properly gained access solely for your personal, non-commercial use. You may not use, copy, adapt, modify, prepare derivative works based upon, distribute, license, sell, transfer, publicly display, publicly perform, transmit, stream, broadcast, or otherwise exploit the Services or Content, except as expressly permitted in these Terms. No licenses or rights are granted to you by implication or otherwise under any intellectual property rights owned or controlled by Scanner Guard Corporation or its licensors, except for the licenses and rights expressly granted in these Terms.

3. Prohibited Uses

You agree not to use the Services:

  • In any way that violates any applicable federal, state, local, or international law or regulation.
  • To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation.
  • To impersonate or attempt to impersonate Scanner Guard Corporation, a Scanner Guard Corporation employee, another user, or any other person or entity.
  • To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Services, or which, as determined by us, may harm Scanner Guard Corporation or users of the Services, or expose them to liability.
  • To use the Services in any manner that could disable, overburden, damage, or impair the site or interfere with any other party's use of the Services.
  • To use any robot, spider, or other automatic device, process, or means to access the Services for any purpose, including monitoring or copying any of the material on the Services.
  • To use any manual process to monitor or copy any of the material on the Services, or for any other purpose not expressly authorized in these Terms, without our prior written consent.
  • To use any device, software, or routine that interferes with the proper working of the Services.
  • To introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.
  • To attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Services, the server on which the Services are stored, or any server, computer, or database connected to the Services.
  • To attack the Services via a denial-of-service attack or a distributed denial-of-service attack.
  • To otherwise attempt to interfere with the proper working of the Services.

4. Products and Purchases

A. Product Information

We strive to provide accurate product descriptions, pricing, and availability information. However, we do not warrant that product descriptions, pricing, or other content on our Services is accurate, complete, reliable, current, or error-free. If a product offered by Scanner Guard Corporation is not as described, your sole remedy is to return it in unused condition.

B. Pricing and Payment

All prices are shown in U.S. dollars and applicable taxes and shipping costs will be added at checkout. We reserve the right to refuse or cancel orders at any time, including if product pricing or other material information on our Services is inaccurate. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order.

C. Shipping and Delivery

Shipping and delivery dates are estimates only and cannot be guaranteed. We are not liable for any delays in shipments.

5. Warranty Disclaimers

THE SERVICES AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.

WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT THE SERVICES AND CONTENT: (A) WILL BE UNINTERRUPTED, SECURE, OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; (B) WILL BE ACCURATE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS; OR (C) THAT DEFECTS WILL BE CORRECTED. WE MAKE NO WARRANTY REGARDING THE QUALITY, ACCURACY, TIMELINESS, TRUTHFULNESS, COMPLETENESS OR RELIABILITY OF ANY CONTENT.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL SCANNER GUARD CORPORATION, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS OR LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; (C) ANY CONTENT OBTAINED FROM THE SERVICES; AND (D) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

IN SOME JURISDICTIONS, THE FOREGOING LIMITATIONS OF LIABILITY MAY NOT APPLY TO YOU. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

7. Indemnification

You agree to defend, indemnify and hold harmless Scanner Guard Corporation, its affiliates, licensors and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services, including, but not limited to, any use of the Services' content other than as expressly authorized in these Terms.

8. Governing Law and Jurisdiction

These Terms and your use of the Services shall be governed by and construed in accordance with the laws of the State of [Your State], without giving effect to any choice or conflict of law provision or rule. Upon termination, your right to use the Services will immediately cease.

B. Waiver

Our failure to exercise or enforce any right or provision of these Terms will not be considered a waiver of such right or provision. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of Scanner Guard Corporation.

C. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

D. Assignment

You may not assign any of your rights or obligations under these Terms without our prior written consent. We may assign any or all of our rights under these Terms, in whole or in part, without obtaining your consent or approval.
